TripShock, Inc. Refer-a-Friend Program Terms & Conditions

Emerald Memories Inc, DBA TripShock (“Tripshock”) may, from time to time, offer our customers and users of our website the opportunity to receive rewards toward future purchases from tripshock.com by referring other real people (“Program”). The Program is enabled through technology provided by Friendbuy, Inc., 7083 Hollywood Blvd. 1st Floor, Los Angeles, CA 90028 (“Platform Provider”). If you choose to participate in the Program, you are subject to TripShock’s website Terms & Conditions and TripShock’s Privacy Policy (both available on our website) as well as the following additional Referral Program Terms & Conditions (“Terms & Conditions”):

Definitions:

Referrer. A “referrer” is a real person who refers other real people to www.tripshock.com. To participate as a Referrer, visit www.tripshock.com/referral and follow the instructions to refer others to the website. There is no limit to the amount of people you can refer. For every “Qualified Referral” (defined below), a Referrer may be eligible to receive “Referral Reward(s)” also defined below.
Referred Customer. A Referred Customer is defined as a real person who visits our website by clicking a Referrer’s Refer-a-Friend Program link embedded into an email, Facebook or Facebook Messenger invitation sent by the Referrer . The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). A Referred Customer will receive 10% off of their first single online purchase of $100 or more at www.tripshock.com within 90 days of referral.
Qualified Referral. A Qualified Referral is defined as a minimum purchase of $100 made at www.tripshock.com and completed by a Referred Customer. Referrers are limited to one Referral Reward for each Qualified Referral; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals and will not earn additional Referral Rewards. A Qualified Referral does not include gift card purchases, or purchases canceled within 24 hours from the booking date. TripShock, in its sole discretion, has the right to determine whether or not a Referrer has made a Qualified Referral based on a Referrer’s adherence to these Terms & Conditions.
Referral Reward. Referral Rewards are earned as the result of Qualified Referrals only. The Referrer shall receive one (1) Referral Reward in the form of a $10 e-gift card, fulfilled by third-party platform Tremendous, to the retailer of the Referrer’s choice for each valid and verified Qualified Referral generated by that Referrer. Referral Rewards are non-transferable, are not redeemable for cash, and are subject to change without notice. Referral Rewards must be used prior to any specified expiration date.
No more than 50 Referral Rewards will be awarded per calendar year. Referrers are responsible for any and all tax liability resulting from Referral Rewards.The Referral Reward is determined by TripShock and is subject to change at TripShock’s sole discretion.

Eligibility:

Eligibility is limited to real, individual persons only. To be a Referrer, you must be at least 18 years old, and be legally permitted to provide the personal information (e.g., name and email address) of each Referred Customer. TripShock’s Refer-a-Friend Program cannot be used by businesses for affiliate lead generation or for any other purpose not specified herein. Employees of TripShock or their subsidiaries, or promotional agencies, including immediate family and household members, are not eligible to participate in the Program. Referrers will receive one (1) Referral Reward for each Qualified Referral.
No Spam. You must comply with all up-to-date “SPAM” laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from therogram.
Right to Close Accounts. TripShock reserves the right to close the account(s) of any Referrer or Referred Customer if the Referrer or Referred Customer attempts to use the Program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation, or for any other reason in its sole discretion.
Right to Cancel or Change Program or Change Terms. TripShock reserves the right to modify, limit, terminate, discontinue or cancel the Program or to change these Terms & Conditions at any time in its sole discretion. If Tripshock changes these Terms & Conditions, we will post the updated version on www.TripShock.com. Any unclaimed Referral Rewards will be forfeited at that time.
Privacy. The personal information of each Referrer and Referred Customer will be collected, processed, and used in accordance with Company’s Privacy Policy, which can be found at https://www.tripshock.com/policy and Platform Provider’s Privacy Policy, which can be found at http://www.friendbuy.com/privacy. In addition, personal information may be used by Tripshock or Platform Provider, on Tripshocks’ behalf, to contact any Referrer or Referred Customer with regard to participation in the Program and to receive communications via the Program.
